ALL PHASE DEVEOPMENT, LLC, an Oregon limited liability company
You are summoned and required to answer the complaint on file in the above entitled Court. The complaint alleges the following claims for relief: breach of contract, unjust enrichment, and personal guaranty for monies due and owing Plaintiff for the short term rental of heavy construction equipment leased by Defendant ALL PHASE DEVELOPMENT, LLC and personally guaranteed by Defendant CLINT PORTER. The sum demanded for the equipment and services furnished by Plaintiff to Defendants is $64,497.86. Within 30 days after service of this summons, you must file your written answer with the clerk of the court at the following address: Fourth District Court-Provo, 125 North 100 West, Provo. Utah 94601, and you must mail or deliver a copy to Plaintiff’s attorneys at the address listed above. If you fail to do so, judgement by default may be taken against you for the relief demanded in the complaint. The complaint is on file wit the clerk of the court.
